RIGHTS AND PERMISSIONS POLICY

(Please read this before requesting copies of items from our collections.)



Researchers must make a written request for permission to quote or publish excerpts from manuscripts in the Douglas Fairbanks Museum, or for one-time permission to reproduce images of any items found in the archives. See "Permission to Reproduce and Broadcast," below.

Permission cannot be granted unless the researcher's letter of request clearly identifies the items in question. Indicate holding unit (e.g., Manuscripts Division); collection name, box, electronic file names and/or folder numbers, if known; name of author or creator; title and date of the item; or any other relevant information. The request letter should clearly identify the forthcoming printed work, electronic publication, or media presentation in which Douglas Fairbanks Museum materials will be quoted, published, or reproduced.

In most cases, the Douglas Fairbanks Museum owns only the physical item, not the literary property or copyright, and therefore assumes no responsibility for violations of such rights or for any other legal issues resulting from the use or publication of the items. It is the responsibility of the researcher to secure permission from the appropriate copyright holder to quote, publish, or reproduce items from Douglas Fairbanks Museum collections, and to acknowledge in print that the materials are used or published "with permission of the Douglas Fairbanks Museum. www.DouglasFairbanks.org"

REQUESTING COPIES OF MATERIALS

There are standard lab fees for the reproduction of photographs, manuscripts, printed books, prints and drawings, audiovisual resources, and other materials from our archives. Copies are available for individual, commercial or nonprofit research purposes at a nominal fee.

Photocopies  - .50 cents per page (B&W) or $1.00 per page (color), plus applicable postage costs if ordering by mail.
High Resolution Digital Photos - $10 (USD) per image scan, plus applicable shipping costs to your country of residence ($4.00 in the USA). Images sent on CD-ROM in JPEG or TIFF format, or via e-mail.

(This fee DOES NOT INCLUDE rights to reproduce any of the items for commercial or nonprofit publication, broadcast or audio-visual presentation purposes. A separate, additional fee structure will apply to photos or artifacts used for professional publication or broadcast purposes, in addition to the $10 lab fee. Please see below for more about publication/broadcast rights and permissions.)

There is a limit of 10 on scan requests, and the limit on photocopies is 50 pages for individual researchers. For larger nonprofit or commercial projects, we do not impose a limit on the number of scans or copies requested, and volume discounts may apply. (20% for 10-20 images, 40% for 20-50 images, negotiable for larger requests.)

Should a researcher wish to use these images for professional, commercial, or broadcast use, they must secure the proper written permissions from the museum Curator or Director. In return for a fee paid in advance to the Douglas Fairbanks Museum, permission may be granted to reproduce or broadcast within a period of three years from the date of the permission letter. The Museum requests (1-2) gratis copies of any publication or audio-visual material that includes Douglas Fairbanks Museum images. Formal permission must be requested in writing at the address below, or via email FairbanksMuseum@cs.com.
 


PERMISSION TO REPRODUCE AND BROADCAST OUR MATERIALS


For purposes of pricing, the Douglas Fairbanks Museum draws a distinction between commercial and non-commercial uses.  A $10 lab fee will automatically be added to all requests, in addition to usage fees detailed below.
 


COMMERCIAL USE AND FEES


Commercial use includes (but is not limited to) for-profit publications (either printed or electronic); textbooks, trade books, reference books, supplemental course readers, and curriculum materials for K-12; motion pictures, commercial television, and video productions; large-circulation or mass-market magazines; printed or televised advertisements; large-format art books and facsimile editions printed primarily in full color and for international distribution; academic works published in press runs of more than 2,000 copies; calendars, posters, museum reproductions, postcards, and note cards; and other items made available to a relatively wide audience.

Standard Commercial Fees
Reproduction on cover, dust jacket, advertisements, etc.: $300.00 per item
Reproduction on an inside page: $50.00 per item
Broadcast or Home Video: $50.00 per item

Discounts: Standard fees apply to the reproduction of 1-5 images at one time. Discounts are given for one-time use of multiple images: 20 percent discount for 6-10 images; 40 percent discount for more than 10 images; negotiable for very large orders.
 


NON-COMMERCIAL USE AND FEES


Non-commercial use includes (but is not limited to) books, videos/DVD’s, exhibition catalogs, and similar works published by libraries, museums, and non-profit organizations; public-television broadcasts; and other items made available to a relatively limited audience.

Standard Non-Commercial Fees
Reproduction on cover, dust jacket, poster, etc.: $150.00 per item
Reproduction on an inside page: $25.00 per item
Broadcast: $25.00 per item

Discounts: Standard fees apply to the rights of 1-5 images at one time. Discounts are given for one-time use of multiple images: 20 percent discount for 6-10 images; 40 percent discount for more than 10 images; negotiable for very large orders.
 


Turn-Around Time for Photoduplication Requests:


NORMAL turn-around for an order of up to twenty images for which no new studio photography is required is TWO WEEKS from the receipt of payment and the completed and signed Permissions Form and Letter of Agreement.

RUSH turn-around for orders of up to ten images for which no new studio photography is required is FIVE WORKING DAYS from the receipt of payment and the completed and signed Permissions Form and Letter of Agreement. Add 50% To The Appropriate Use Fee.

TWO WORKING DAY turnaround is available for orders of to five images for which no new studio photography is required, and for which photographic prints, slides, or transparencies already exist. A high-resolution scan, shipped on CD-ROM or via e-mail, AND NOT A PHOTOGRAPHIC PRINT can be provided. Add 100% To the Appropriate Use Fee.

WAIVED FEES


Fees are sometimes waived for black-and-white reproduction of a few images of textual or visual materials on inside pages of a scholarly journal (either printed or electronic), in an academic publication with a press run of fewer than 2,000 copies, in a scholarly microform or electronic edition, or a non-commercial web site where content is of an educational nature. Reproduction fees in these specific cases will be waived for everyone, whether or not a member of the Douglas Fairbanks Museum. However, even when fees are waived, existing photoduplication/lab  charges must be paid in advance, and permission to reproduce images must be requested in writing in order to guarantee that citations are accurate.
 


ONE-TIME USE


 


Permissions are granted solely for non-exclusive, one-time use per medium. This means photomechanical, electronic, film, and other forms for the reproduction of an image in a specific work, presented in a single edition or medium published in one language, either for commercial or non-commercial (including academic) purposes.

Subsequent uses, such as revised editions, paperback reprints, foreign-language translations, audiovisual adaptations, web-based applications, or electronic editions in CD-ROM, video/DVD or other formats, will require separate application to the Douglas Fairbanks Museum for written permission, which may be granted in return for pre-payment of additional fees. The museum offers a “Multiple formats” package for the convenience of producers who would like to use our images in multiple editions (such as a companion VHS/DVD edition, CD-ROM, or web gallery) – please inquire about these special discounted rates.

The Douglas Fairbanks Museum does not grant permission for exclusive use, and thus the Douglas Fairbanks Museum may grant reproduction permission for particular items to be reproduced or broadcast in more than one place at the same time. New reproduction fees will be charged for photographic copies of Douglas Fairbanks Museum images previously obtained from the Douglas Fairbanks Museum for other purposes, or obtained from sources other than the Douglas Fairbanks Museum, or reproduced from Douglas Fairbanks Museum materials reproduced in previously published or broadcast works.
 


CREDIT LINE AND COPYRIGHT


The reproduction must be accompanied by a credit line that will be supplied by the Douglas Fairbanks Museum. The text of the required statement will vary with the item reproduced and the medium. Specific wording may be required with certain materials. Permission to reproduce is granted by the Douglas Fairbanks Museum as far as its rights extend as owner of the physical object. Credit lines for film, television, and video may be run at the end of the program or presentation. This credit line generally should read “The Douglas Fairbanks Museum. DouglasFairbanks.org,” although this credit line may vary by specific item.

Please bear in mind that in almost all cases the Douglas Fairbanks Museum only owns the physical object and therefore does not assume any responsibility for literary property, copyright, or any other legal issues involved in the publication and reproduction of items in its collections. In the case of both textual and visual materials (including photographs and works of art), it is the responsibility of the user to secure permission from the appropriate copyright holder. While many of our artifacts are now considered to be in the public domain, the museum makes no warranty of such, either expressed or implied.

It is the responsibility of the requester to determine the copyright protection status of each item they wish to use, and secure the proper releases/permissions as may be necessary for works not in the public domain.
 


SPECIAL CONDITIONS


Not all images are available for reproduction because of copyright, access restrictions, and conservation considerations. It is the policy of the Douglas Fairbanks Museum that its images may not be manipulated as to alter their meaning and that their integrity must be retained. Particular images may not be combined with other images, whether from the Douglas Fairbanks Museum or other sources. Images must be reproduced in their entirety. If only details of images are reproduced, this fact must be clearly indicated. Reproduction of Douglas Fairbanks Museum materials from halftones found in print publications will generally not result in satisfactory image quality, in which cases, the reqestor may be granted special permission to digitally alter/cleanup image.
